Introduction

Stand Up Paddleboards (SUP’s) and equipment can only be hired upon completion of a booking form along with an agreed payment and security deposit. The signatory of the booking is the designated hirer, confirming that he or she has the authority to make such a booking on behalf of other persons. Upon acceptance by us of your completed booking form a binding contract is formed between you and us on the terms and conditions set below. We reserve the right not to accept or fulfil a booking. All bookings are subject to availability.

The hire period commences on the day the equipment is collected by or delivered to you and continues until the equipment is returned to us.

As signatory of this booking you accept responsibility for ensuring that any members of the group included in the hire covered by this booking form comply with the terms and conditions herein.

 

Your responsibilities

You are responsible for ensuring you are physically fit enough to stand up paddle board. Any  medication you do need make sure you have it with you on the water. All users must be competent and confident in their abilities to navigate a SUP and able to swim 25 meters unaided. We do not accept liability for changes in your period of hire due to weather and other causes out of our hands. You accept responsibility to indemnify us against any claim, interest, demand or expense in respect of such injury or damage.

You are responsible for all SUP’s and equipment hire, keeping it safe from damages, loss or theft. Use it respectfully and not cause unfair wear and tear.

You will notify us immediately of any loss, damage or theft to the hired SUP’s and equipment and will be responsible for paying us reasonably costs of reparation of any such loss, damage or theft. 

You will not offer for sale, sell, dispose, mortgage, lend or pledge or otherwise part with the hired stand up paddle boards and equipment.

You understand that you are participating in stand up paddle boarding at your own risk.

Buoyancy aids are to be worn at all times on and around the water. You must provide your own suitable clothing to wear during the time of hire.

You will paddle the SUP responsibly at all times. Hire will be revoked during your hire period in cases of reckless behaviour, putting others lives at risk, with no refund will be given.

Clients who booked by telephone will be deemed to have read and accept these terms and conditions.

You have the right to terminate this agreement at any time leading up to the time of hire, however unless we agree otherwise you will not be entitled to a refund. Extra carriage charges may have to be made if stand up paddle boards and/or equipment have to be picked up, other than from the agreed termination point.

Hire on the day is subject to safe weather conditions. If a postponement of your hire is deemed necessary by Stand Up Paddleboard UK, we will give you as much notice as possible and we will offer you alternative dates, if no convenient alternative date can be agreed, any monies paid will be fully refunded.  

You agree to only use the SUP’s and equipment in the manner described by Stand Up Paddleboard UK and to use them on the Llangollen canal upstream of the launching location ending at the source of the canal, or any other location stated by Stand Up Paddleboard UK only. You are strictly forbidden to take the paddleboards and equipment across any aqueduct or viaduct. You must give way to barges, by moving onto your knees and moving over side opposite the tow path (to allow horse drawn barges to pass safely). When reaching a tunnel we recommend that one of your party safely dismounts the board and walks the tow path to check if any barges or other water users are coming through. The barges have priority (horse drawn barges cannot stop easily) so if you do encounter a barge in the tunnel you must retreat out of the tunnel as quickly as possible. 

 

Personal safety

Each participant is responsible for their own safety. You must not be under the influence of drugs or alcohol when using the paddle boards. Hire will be revoked during your hire period if you become intoxicated, with no refund given.

Young persons under the age of 18 must be accompanied by an adult while on or near the water.

Stand Up Paddleboards must not be used during hours of darkness. Any equipment including paddleboards must not be left unattended at any time. 

You must be respectful of other water users in crafts such as barges, kayaks, paddleboards, swimmers and fishermen.

 

Payment and deposit

Payment for the whole hire period is required before hire commences along with the completed booking form. Proof of identity may be required in the form of a valid driving licence or passport.

At our discretion a holding deposit of £100 or a set of car keys may be required per paddleboard hire. This may be increased to the value of the paddleboard/equipment by bank transfer or other methods deemed suitable by us depending on our assessment of risk and value of paddleboards/equipment. This deposit will be returned in full provided that:

  • Paddleboards and equipment are used and returned in an undamaged condition to us and

returned within the arranged time period and place.

If the terms stated above are not complied with, we reserve the right to charge reasonable charges until the paddleboards/equipment are returned to us. If paddle boards/equipment are returned damaged you are responsible for the costs incurred and sustained in replacing or repairing the items concerned to a condition equivalent to that before hire commenced. In all cases normal wear and tear as defined by the products manufacturer or supplier is accepted and allowed and is included in the hire price.

In all cases the security deposit can be used as a deposit against the costs or charges mentioned herein.

 

Our liabilities to you

Stand Up Paddle Board UK accepts responsibility for death, personal injury and direct loss or damage suffered by you which you can demonstrate was caused by our negligence up to the limit set out below.

We will not be liable to you where any alleged loss or damage results from:

  • any of your own actions or omissions
  • the action or commission of a third party not connected with the provision of your paddle board hire.
  • an event or circumstances which we could not have predicted or avoided even after taking all reasonable care.
  • where any loss or damage is considered to be indirect or consequential loss.

Except in respect of death and personal injury, in respect of which no limit of liability shall apply, our total liability to you under this contract between us shall be limited to the total cost of your booking.

We shall have no liability to you if we are unable to fulfil a booking due to an event of force majeure. In the event of us being unable to fulfil your booking, our liability to you shall not exceed the agreed cost of the hire.

Except where expressively permitted under the Data Protection Act 1998, we will only use your personal details in connection with your booking arrangements, unless you agree otherwise.

 

INSURANCE Stand Up Paddle board UK confirms that it is covered by public and employers liability insurance; however we offer no insurance cover regarding personal accidents to individuals that may occur during the term of this hire agreement. In your own interest paddle boarding involves an element of risk; you are strongly advised to take out insurance cover against accident, emergency rescue, and personal injury, loss of luggage, equipment damage and cancellation.

Cancellation We require 48hrs notice if you need to cancel for any reason.  Less than 48hrs notice and we will not be able to give you a refund.  If for any reason Stand Up Paddle Board UK have to cancel due to poor weather we will refund hire charges but are not liable for any other expense incurred.

These terms and conditions constitute the entire agreement between you and us.
